Kelly Fauth has had conditions placed on her nursing registration:

Conditions:

Counselling Conditions

1 Within two (2) weeks of the imposition of these conditions, the practitioner must nominate to the Office of the Health Ombudsman for approval in writing a counsellor, psychologist or psychiatrist (‘the counsellor’) to address with the practitioner the following areas of conduct and performance:

a impulse control;

b communication; and

c anger management

2 At the time the practitioner provides information regarding the counsellor to the Office of the Health Ombudsman, the practitioner must also provide:

a the contact details and the qualifications of the counsellor;

b written confirmation from the counsellor that they have read these conditions and are able to provide a counselling service to the practitioner that meets these conditions.

3 The practitioner must complete a minimum of six (6) sessions with the counsellor, within three (3) months of receiving notice from the Office of the Health Ombudsman of the Health Ombudsman’s approval of the counsellor (‘the counselling period’).

4 Within seven (7) calendar days of the practitioner’s completion of three (3) of the minimum six (6) sessions the practitioner must provide to the Office of the Health Ombudsman an intermediate report from the counsellor indicating the practitioner’s engagement in the counselling sessions and the progress the practitioner has made in relation to addressing the areas of conduct and performance identified at paragraph 1(a)-(c) of these conditions.

5 Within seven (7) calendar days of the practitioner’s completion of the six (6) counselling sessions, the practitioner must provide to the Office of the Health Ombudsman a final report from the counsellor demonstrating, to the satisfaction of the Health Ombudsman:

a the practitioner’s engagement in a minimum of six (6) sessions with the counsellor over the counselling period;

b the outcomes achieved by the practitioner over the counselling period; and

c the progress the practitioner has made in relation to addressing the areas of conduct and performance identified at paragraph 1(a)-(c) of these conditions, including the practitioners level of understanding and strategies undertaken to prevent future incidents the subject of these conditions.

6 The cost of the counselling is to be borne by the practitioner.

Notice to Employers

7 Within two (2) business days of the commencement of these conditions, the practitioner must notify all current employers (see below foot note 1) and/or places where the practitioner practises or works as a registered health practitioner as to the existence of the conditions imposed on the practitioner’s registration and provide them with a copy of this Schedule of Conditions.

8 Within five (5) business days of the commencement of the conditions or of commencing in any new place of employment as a registered health practitioner, the practitioner must provide to the Office of the Health Ombudsman an Employer acknowledgment of conditions form, from their employer, certifying that the employer is aware of the conditions imposed on the practitioner’s registration and that they have been provided with a copy of this Schedule of Conditions.

Other Matters

9 Within five (5) business days of changing residential address, the practitioner must notify the Health Ombudsman in writing of that change and provide new contact details.

10 The practitioner must immediately advise the Office of the Health Ombudsman if at any time the practitioner is charged with any criminal offence.

Period of Conditions

11 The imposition of conditions will take effect on the day the Notice of decision is given to the practitioner, pursuant to section 60 of the Act.

12 Pursuant to section 62 of the Act, the decision to take immediate registration action continues to have effect until the earlier of the following happens:

a the Queensland Civil and Administrative Tribunal (‘QCAT’) sets aside the decision –

i on application by the practitioner for a review of the decision; or

ii on referral of the matter to QCAT by the Director of Proceedings on the Health Ombudsman’s behalf; or

b the Health Ombudsman removes the conditions under section 65 of the Act..

Footnote 1, for the purposes of these conditions, ’employer’ means an entity that –

(a) employs the practitioner to provide health services; or

(b) engages the practitioner to provide health services under a contract for services; or

(c) operates a facility at which the practitioner provides health services.

‘Employer’ includes co-owners, co-directors, contractors of service, and/or owners/operators of medical practices, hospitals and/or facilities where the practitioner provides a health service (even if there is no contractual relationship between the practitioner and the owner/operator).

1 An inherent power imbalance exists within the relationship between people receiving care and nurses that may make the persons in their care vulnerable and open to exploitation. Significant vulnerability and powerlessness can arise from the experience of illness and the need to engage with the health care system. Addendum 3

Social Media Policy

When using social media, health practitioners should remember that the National Law, their National Board’s code of ethics and professional conduct (the Code of conduct) and the Guidelines for advertising regulated health services (the Advertising guidelines) apply.

Registered health practitioners should only post information that is not in breach of these obligations by:

  • complying with professional obligations
  • complying with confidentiality and privacy obligations (such as by not discussing patients or posting pictures of procedures, case studies, patients, or sensitive material which may enable patients to be identified without having obtained consent in appropriate situations)
  • presenting information in an unbiased, evidence-based context, and
  • not making unsubstantiated claims.

Additional information may be available from professional bodies and/or employers, which aims to support health practitioners’ use of social media. However, the legal, ethical, and professional obligations that registered health practitioners must adhere to are set out in the National Boards’ respective Code of conduct and the Advertising guidelines.
